[摘要]

921集集大地震後災情幾乎遍及台灣的每一個角落,政府投入大量人力與物力等資源協助災

民作震損建築物重建及復建的工作,惟建築物之震損程度認定有其困難之處,且因涉及災

民之權益頗大,政府始終不願就其所認定之建築物震損程度之認定效力,作一明確定義,

致使災後復建及重建之進度嚴重延宕。為提供適宜台灣本土民情及法令之震災後建築物處

理機制之建議,實有必要對921大地震發生後政府相關處理措施及政策作更進一步的瞭解。

本研究以台北市政府為對象,藉由實際參與承辦震災業務之經驗及相關資料之收集,對政

府在震災後建築物處理機制之相關議題作一瞭解,以作為研擬如何改進之基礎資料。收集

項目除政府相關法令、與美日等先進國家之政策外並針對災民之訴求與政府政策之落差作

深入的分析及調查,藉此瞭解:

1)政府在震損建築物認定及後續重建或復建所扮演之角色

2)災民期望政府就震損建築物認定及後續重建或復建所扮演之角色

3)美日等先進國家如何擬定震損建築物之相關復建機制

根據調查所得,災民期望政府能訂定更為明確且統一易遵行之法令,尤其是明定災損程度

之認定標準及其衍生之法令效力及加強建築復建協助等規定應更為明確,俾利辦理後續復

建作業之依據。

由於震災之發生位置及對各地建築物之影響不一,故應依震損建築物之損壞程度擬定不同

的配套措施,方為一完善之震災後建築物處理機制。

 

 

[摘要]

After the 921 Chichi Earthquake, the effects of the casualty spread to almost 

every corner of Taiwan. The government involved a lot of resources, including 

manpower and materials, on assisting the victims to rebuild their buildings 

and helping them with their recovery work. Nevertheless, it was difficult to 

judge the extents of damage of buildings in the earthquake. Since the rights 

and interests of victims had been extensively affected, from the very 

beginning the government did not make a clear definition for the identification

of the extent of damage of building in the earthquake. Consequently, the 

progress of reconstruction and rebuilding work after the earthquake had been 

seriously delayed. In order to give suggestions for the handling mechanism of 

post-casualty buildings that meets the conditions of local people as well as 

the laws, it is really necessary to make a thorough understanding of the 

handling measures and policies of the government after the 921 Earthquake.

Taking Taipei City Government as the target, and based on the experience of 

actual involvement in providing relief and the information accumulated, this 

research paper intends to understand the issue of the handling mechanism of 

post-casualty buildings, which can be the basic information for exploration of 

the improvement work. Apart from collecting the items that cover the relevant 

government regulations and the policies of the advanced countries, such as 

Japan and the United States, this research paper also focuses on the 

difference between the expectations of the victims and the policies of the 

government, and then make deep analysis and investigation, so as to understand:

(1) The role of government in the judgment of the damage of buildings, and in 

the post-casualty rebuilding or reconstruction.

(2) The victims expected role of government in the judgment of the damage 

of buildings, and in the post-casualty rebuilding or reconstruction.

(3) How the advanced countries, such as the United States and Japan, etc. 

formulated the relevant reconstruction mechanism of the damaged buildings in 

earthquake.

According to the results of investigation, the earthquake victims expect that 

the government can formulate clearer and unified decrees that can be observed 

by them easily. Especially on the identification standards of the extent of 

damage, the effectiveness of laws derived, and the strengthening of the 

assistance on reconstruction of buildings, there should be clearer guidelines 

which can be the reference for follow-up reconstruction operation.

Since the impacts on different buildings are different due to the different 

extents of earthquake attack at different locations, there should be different 

measures for the buildings with different extents of damage to follow so as to 

accomplish a sound and effective handling mechanism of post-casualty buildings.
